1. Acceptance of Terms

Welcome to Attractify Marketing ("Attractify," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website at attractifymarketing.com, including the free AI Visibility Scan, our blog, and our other resources (the "Website"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Website.

These Terms constitute a legally binding agreement between you and Attractify Marketing LLC.

Clients

If you use the Attractify client portal at portal.attractifymarketing.com or buy any Attractify service, the Attractify Client Portal Terms of Service govern that use. They incorporate these Terms, and they control if the two conflict.

2. Free AI Visibility Scan

We offer a free AI Visibility Scan that provides a one-time analysis of a domain's visibility across AI platforms. No payment is required for the free scan. Scan results reflect how AI platforms responded when the scan ran, are provided for information only, and may change over time. We may limit, change, or stop offering the free scan at any time.

3. Acceptable Use

You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Website to violate any local, state, national, or international law
  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Attempt to gain unauthorized access to any portion of the Website or any other systems or networks
  • Use the Website to transmit any viruses, malware, or other malicious code
  • Interfere with or disrupt the Website or servers or networks connected to the Website
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
  • Use automated systems (bots, scrapers, etc.) to access the Website or the free scan without our prior written consent

4. Intellectual Property

Attractify retains all ownership rights to the Website, including all software, designs, graphics, text, articles, and other content on it. You may view the Website and share links to it, but you may not copy, modify, distribute, sell, or lease any part of the Website without our prior written permission.

Attractify's client services integrate with Google APIs, including the Google Analytics Data API, Google Analytics Admin API, Google Search Console API, YouTube Data API v3, YouTube Analytics API, and Google Tag Manager API, through access each client grants with OAuth 2.0. Section 5.5 of the Client Portal Terms of Service governs that access. Among other things, it provides that:

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Website, you consent to the collection and use of your information as described in our Privacy Policy, including the measurement of visits and enquiries described there.

7. Website Monitoring

As part of operating and securing the Website, we may monitor application errors and performance using Sentry, a third-party error-monitoring and performance-tracing service, and may also record a masked replay of your on-screen activity to help us diagnose and fix problems: all on-screen text and form inputs are masked before the replay leaves your browser. 8. Website Availability and Modifications

We strive to keep the Website available, but we do not guarantee that it will be available at all times. We may perform maintenance that temporarily interrupts the Website, and we may modify, suspend, or discontinue any part of the Website at any time.

9. Disclaimer of Warranties

THE WEBSITE, INCLUDING THE FREE SCAN, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Attractify does not warrant that:

  • The Website will meet your specific requirements
  • The Website will be uninterrupted, timely, secure, or error-free
  • The results of the free scan or any other information on the Website will be accurate or reliable
  • Any errors in the Website will be corrected

Content on the Website, including the free scan and our articles, is general information and not legal, financial, or other professional advice. We do not guarantee specific results from acting on it, including improvements in AI visibility, increased traffic, or business growth.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATTRACTIFY, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Website
  • Any conduct or content of any third party on the Website
  • Any content obtained from the Website
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL ATTRACTIFY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE WEBSITE EXCEED ONE HUNDRED U.S. DOLLARS ($100). If you are a client, the Client Portal Terms of Service govern liability for the services they cover.

11. Indemnification

You agree to indemnify, defend, and hold harmless Attractify, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

  • Your access to or use of the Website
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any content you submit or transmit through the Website

12. Third-Party Links

The Website may contain links to third-party websites or services that are not owned or controlled by Attractify. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Website shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and judgment on the arbitration award may be entered in any court having jurisdiction.

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action or other representative action.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make changes, we will post the updated Terms on this page and update the "Last updated" date at the top. Your continued use of the Website after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Website.

15. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Attractify regarding the Website and supersede any prior agreements. If you are a client, the Client Portal Terms of Service also apply, as described in Section 1.

Waiver and Severability

The failure of Attractify to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Assignment

You may not assign or transfer these Terms without our prior written consent. Attractify may assign or transfer these Terms at any time without restriction.
